TAMPA, Flor. - In the state of Florida, children who sustain severe brain or spinal cord injuries during birth are eligible for lifetime benefits. However a new class action lawsuit claims that a pair of Tampa Bay parents and other have not received the full compensation they are owed for tending to the needs of their disabled children.

A county judge has certified the class action suit, but has yet to rule on the merits of the claim. Yet in his order, the judge cited evidence of the Florida Birth-Related Neurological Injury Compensation Association refusal to pay some parent in full.

The association is responsible for distributing funds for a wide range of needs deemed medically necessary and reasonable.

If your child has suffered a birth injury and you believe it is due to the doctor’s or hospital’s negligence, you may be entitled to recover damages for your losses. Contact the Racine birth injury lawyers of Habush, Habush, & Rottier, S.C. at 800.682.3434 for a free initial consultation. We will discuss your case and further legal options.

Ohio - In an effort to restore some peace to their children and immediate families, the George family has agreed to pay the son of the slain Jeff Zack $650,000. The civil suit was brought on after Cynthia George’s conviction for soliciting a third party to murder Zack was overturned.

George had been found guilty of soliciting her current lover John Zaffino to kill her former lover Zack in 2001. Her sentence was overturned after a 9th circuit appeals court ruled that, although Zaffino was guilty of Zack’s murder, the case lacked sufficient evidence to prove that George solicited him to commit the murder.

Zack’s 19-year-old son is a university student. He will be awarded $428,000 from the settlement, with the rest going towards attorney’s fees.

The Centers for Disease Control and Prevention release a warning to parents about a very dangerous that has taken the lives of nearly 90 young people. The “choking game”, also called “space monkey” and the “pass out game”, is played by teens to get a quick high without drugs or alcohol. The game involves intentionally choking one’s self to reach a brief euphoric state.

Victims of the game, 82% of whom were male, typically die because the strangulation is prolonged. What has become particularly dangerous about the game is that kids are now using ligatures like belts, ropes, and scarves to hang themselves. And they are playing alone, evermore increasing the danger with no one there to help them.

Signs that children have been participating in the game include bloodshot eyes, headaches, bruises around the neck.

Parents who serve alcohol to teens could face a lawsuit under state of New York law. According to the law, if a person serves alcohol to a minor and they injure themselves or someone else, that person is civilly liable and can be sued for damages suffered.

Most state laws find parents criminally culpable for serving drinks to minors, as well as if an injury occurs.

Under the NY law, party hosts would have to pay for damages suffered by the teenagers involved as well any third parties. This includes bodily injury, mental health, and destruction of property. This is covered under premise liability law which states that owners or tenants of real estate are responsible for injuries to individuals using that property.

If you or a loved one has suffered due a teen drinking accident, contact a Racine Personal Injury Lawyer by calling 1-800-682-3434 today.

A lawsuit was filed in the Cheyenne County District Court against Mid Plains Food and Lodging who owned the KFC/Taco Bell. The family of Keith Andrew was awarded $40,000 Friday.

KFC does not support the verdict and states they are committed to food safety. The two little boys became extremely ill and were hospitalized after eating the food. Workers saw the employee contaminate the food and reported it to managers, but the managers failed to contact the family.
