Sports Bar Wants Out of Dram Shop Suit

 A sports bar facing a dram shop suit seeking $200,000 in damages is filing to have the charges against it dropped.

The male plaintiff  filed suit against the drinking establishment alleging that he sustained injuries in an auto accident while he was a passenger driven by the co-defendant in the suit, who had been drinking at the bar prior to the accident.  The plaintiff, who was also drinking at the bar, claims he was of the legal drinking age, but that the female defendant was not yet 21-years-old at the time of the accident.

He claims the co-defendant became intoxicated from the beverages she was served while at the bar named in the suit.  The suit alleges that the plaintiff fell asleep and passed out at the bar sometime throughout the night.  Bartenders had to carry and assist him to the co-defendant’s car, but failed to restrain him with a seat belt.

Once on the freeway, the co-defendant lost control of her vehicle causing it to overturn several times.
