Florida families sue state for witholding birth injury assistance

 TAMPA, Flor. - In the state of Florida, children who sustain severe brain or spinal cord injuries during birth are eligible for lifetime benefits.  However a new class action lawsuit claims that a pair of Tampa Bay parents and other have not received the full compensation they are owed for tending to the needs of their disabled children.

A county judge has certified the class action suit, but has yet to rule on the merits of the claim.  Yet in his order, the judge cited evidence of the Florida Birth-Related Neurological Injury Compensation Association refusal to pay some parent in full.

The association is responsible for distributing funds for a wide range of needs deemed medically necessary and reasonable.
