Fatal Cement Truck Collision Leads to Lawsuit

A wrongful death lawsuit has been filed against the driver of a cement truck in connection with a collision which killed a woman on State Highway 183. Maria Gamez, 41, was killed on April 11, after Edward Magallon lost control of his cement truck and crashed into Gamez’s SUV. The lawsuit also names the driver’s employer, Texas Industries, Inc. as a defendant, claiming it should never have allowed someone with Magallon’s poor driving safety record to operate a commercial truck.

According to Department of Public Safety records, Magallon has prior convictions for DWI, failing to maintain motor vehicle insurance, ignoring traffic control devices, and speeding while operating a commercial vehicle. His license was suspended in both 2005 and 2006.
