Parents who serve alcohol to teens could face a lawsuit under state of New York law. According to the law, if a person serves alcohol to a minor and they injure themselves or someone else, that person is civilly liable and can be sued for damages suffered.
Most state laws find parents criminally culpable for serving drinks to minors, as well as if an injury occurs.
Under the NY law, party hosts would have to pay for damages suffered by the teenagers involved as well any third parties. This includes bodily injury, mental health, and destruction of property. This is covered under premise liability law which states that owners or tenants of real estate are responsible for injuries to individuals using that property.

Additionally, experts estimate that if incorrect prescriptions and pharmacy errors are added into this statistic, it could skyrocket as high as 50,000 deaths a year. If approved, the Carmelo Rodriguez Military Medical Accountability Act, proposed by New York congressman Maurice Hinchey, would reverse a 1950 U.S. Supreme Court decision that protects the military from medical malpractice lawsuits. The bill would allow claims for damages for death or personal injury cases resulting from negligence, failure to act, or wrongful acts in medical and dental practices. The lawsuits would be brought against the military, as an institution, rather than the individuals performing or not performing the acts.
The bill is named for Carmelo Rodriguez, who died at the age of 29 because military doctors misdiagnosed malignant melanoma as a birthmark. Supporters of this bill claim it will protect officers from lawsuits from lower ranking military members while also holding doctors accountable for their level of medical care.

Former Food and Drug Administration (FDA) commissioner David Kessler, who served from 1990 to 1997, has come out against a proposed ban on lawsuits supported by the FDA and major food and drug companies. Under the legal doctrine known as preemption, states and consumers would no longer be able to sue companies over any products which had earned FDA approval.
According to a copy of Kessler’s testimony, the FDA is simply too underfunded to compete with the vast resources of major corporations. Its ability to catch potential problems with a new product is too limited to make preemption a viable doctrine.
Other prominent opponents of the proposed bad, including actor Dennis Quaid, have also voiced concerns, saying that any ban on lawsuits would remove the threat of liability, the strongest incentive for large corporations to act responsibly and ensure the safety of their consumers.
