If approved, the Carmelo Rodriguez Military Medical Accountability Act, proposed by New York congressman Maurice Hinchey, would reverse a 1950 U.S. Supreme Court decision that protects the military from medical malpractice lawsuits.  The bill would allow claims for damages for death or personal injury cases resulting from negligence, failure to act, or wrongful acts in medical and dental practices.  The lawsuits would be brought against the military, as an institution, rather than the individuals performing or not performing the acts.

Former Food and Drug Administration (FDA) commissioner David Kessler, who served from 1990 to 1997, has come out against a proposed ban on lawsuits supported by the FDA and major food and drug companies. A wrongful death lawsuit has been filed against the driver of a cement truck in connection with a collision which killed a woman on State Highway 183. Maria Gamez, 41, was killed on April 11, after Edward Magallon lost control of his cement truck and crashed into Gamez’s SUV. The lawsuit also names the driver’s employer, Texas Industries, Inc. as a defendant, claiming it should never have allowed someone with Magallon’s poor driving safety record to operate a commercial truck.
